No. You and your client retain complete control of the litigation.

At the time your client needs additional assistance, we will further evaluate your client’s case, and, in most cases, will advance additional funds. However, the total amount advanced will rarely exceed 10%-15% of your client’s expected recovery, after your fees and expenses.

Yes. You will need to sign the “Acknowledgement by Counsel” where you acknowledge the assignment of a portion of the proceeds and agree to pay the amount due from the settlement proceeds to 5 Star Legal Funding upon settlement of the case. There are four easy ways to refer your clients to us. The fastest is to call us directly at 888-5-CASH-05 or 516-599-4000, provide the case details, and we’ll take it from there.

Usually, we request a copy of the Plaintiff’s Complaint, the Defendant’s Answer, Police or incident reports, a list of medical bills incurred and a copy of relevant medical records (i.e. Surgery reports, MRI reports, etc.). We will never request documents or information that is subject to the attorney-client privilege.

Yes. It is absolutely ethical and legal to refer clients to us. What we do is make legal funding a useful and sustainable tool for your clients, while affording you the time to negotiate the best possible settlement or verdict.

Answers for Clients

It is a non-recourse advance. What that means is that you are selling a portion of the potential proceeds of your lawsuit. It is paid from your recovery, after your attorney’s fees. If you do not win your case, you owe nothing to 5 Star.

We do not want the financial assistance you receive from 5 Star to hinder your attorney’s ability to settle your claim. For that reason, we will not advance more than 10%-15% of your expected recovery, after attorney’s fees.

In most cases, it takes 24 hours.

A lawsuit does NOT need to be filed. 5 Star will provide advances, as long as there is sufficient information and documentation to allow us to evaluate your claim.

No. There are no upfront fees. You pay nothing until your case settles.

We charge an application and processing fee and this fee varies under certain circumstances. The rate on your pre settlement advance is always 16% non-compounding for each 6 month period of time.
